Is online gambling advertising within the freedom of speech boundries?

A major media group recently paid $7 million to avoid a confrontation with the Department of Justice over advertising.
The events, which were published on OnlineCasinos.com, are not expected to have a long-term effect on media companies from accepting gambling advertising.
Nevertheless the Department of Justice does continue to discourage US media executives from accepting these adverts by warning them of their possible legal infringement.
Such legal action has come as a surprise since in recent times the Department hasn’t made much public fuss.
Michael Corfman, Chief of Casino City confirmed the rumors circulating at the recent International Casino Exhibition that he had dropped his company's case against the Department.
Initially, Corfman had intended to fight the action. In 2004 he hired a top legal team to file and seek a ruling from the US court, that showed the Department of Justice was impinging the First Amendment to the US Constitution by barring his right to advertising.

Ironically, it wasn’t the fight that perturbed Michael Corfam to drop his case, rather it was the endless silence emanating from the Justice Department which encouraged him to halt with the litigation. This offers no tangible solution to the problem. In fact, it allows the Department to continue with its threats, leading to continued fear of prosecution for media companies. Until this issue is challenged and resolved, online gambling advertisements continue to tread on risky grounds.
